In addition to preparing its own court reports, EE&MC also analyses and evaluates reports prepared by court-appointed experts. This critical review covers the data used, the economic assumptions and the empirical methods applied.
Particular attention is paid to compliance with the requirements emphasised by the German Federal Court of Justice regarding the data basis, methodological plausibility, disclosure of calculation methods and justification of the chosen economic models. EE&MC checks whether the causal relationships presented are soundly derived, the empirical findings are robust and the conclusions are economically justifiable. Any incorrect specifications, inadmissible causal interpretations or methodological inconsistencies are disclosed and explained in economic terms. In this respect, EE&MC also offers services as a ‘senior expert’.
EE&MC's experts have extensive experience in presenting evidence in and out of court and are familiar with the requirements for the admissibility of economic analyses in court. In this way, EE&MC ensures that both its own and third-party economic reports meet the highest standards of scientific rigour, transparency and legal validity.
