Concurrenes - Paris April 2, 2026

In early April, I had the opportunity to speak in Paris at a conference hosted by Concurrences on private enforcement in competition law.

My contribution focused on developments in Germany, with particular emphasis on the role of economic experts in court proceedings. In practice, economic expert evidence has become a central pillar of damages litigation - shaping the assessment of harm, the quantification of damages, and ultimately the effectiveness of private enforcement. This raises not only methodological questions, but also procedural ones, especially regarding the interaction between courts and economic expertise.

The broader discussion addressed the evolving function of private enforcement as a complement to public enforcement, including recent trends in litigation, access to evidence, and the calibration of national procedural frameworks within the EU context.

The conference brought together a distinguished group of practitioners, academics, and judges, enabling a substantive and forward-looking exchange.
